Terms Of Service

Terms of services are subject to chance so please read before commissioning me.
By commissioning me, the artist, in any kind of way, you are agreeing to the terms of service listed below. Any concerns and questions you might have, don’t hesitate to message me on Instagram @maitrevoleur_art or email maitrev.art@gmail.com
General Terms
​When commissioning me, please provide the following:

Clear references of your character, I do not work with descriptions and traditional images.

State the character’s name, any gender, and species.

If your character has something specific in their design please mention it, otherwise I won’t know. (markings, earrings, etc.)

Any pose, or expression wanted if not it will be at the artist's choice. (Please state in when commissioning )

Please write in a clear and nice manner.

I reserve the right to cancel/decline a commission for any reason. I furthermore reserve the right to decline to do business with any person at my own discretion, at any time.

*In addition, failing to follow the rules/TOS provided will result in your commission being declined/cancelled.

I will not draw in another artist's style, please check my socials or the commission examples to get an idea of what to expect.

You will be sent via email a PNG file once the pieces has been finished and paid in full.

Due to recent events, any art done by me should not be altered in any way or form, especially using AI software or programs. Doing so, will result in the person getting blacklisted.

If you are under the age of 18, you must get approval from your parents. I am not responsible of conflicts between parents/legal guardian and the client.
Payment
-
I will only start a commission after payment has been received.
-
I accept payment through Paypal, Square, and Stripe (USD).

PLEASE do not include your address in the payment invoice/form.
-
Prices are subject to change depending on the complexity of the commission.

Once Paypal invoice is sent, the client must provide payment within a 48 hrs, if not the commission will be canceled.

Any chargebacks will be blacklisted and shared on socials with a beware.
Deadlines and Waiting times
-
I do not accept deadlines since I am in University and my time is divided.

A commission could take 4 weeks or to 5-6 months to be completed. As I work on in order of who commissioned first to last. (First come, First serve)
-
Traditional commission might take longer if I don’t have the material/color of the character (ex. Copic pen). You will be notified.

Lineless commission will take longer due to the complexity up, 3 weeks up to 3 months.

Please do not harass me constantly about your commission. However, you may ask if a week has passed.

My list is first come, first serve and commissions will be done by order. As a result the commission will be in order of first to last.***

Please wait until is your turn in the commission list, when I start with yours then you' ll be contacted*
Shipping (Badges Only)
Shipping currently applies to badges both digital and traditional, not digital illustrations since I am not providing physical prints for the time being.

I am NOT responsible for the artwork once its shipped. I won’t replace nor refund for artwork being lost or damaged in the mail. However, please contact me.

Commissioned work will be mailed inside a bubble mailer with standard shipping.

I will ask the address through email or your form of contact.

Shipping doesn't contain tracking for badges, but can be added for a fee.
WIP/Edits
-
I will send a sketch to be approved before I start linework.
-
Once I started the inking process, no changes can be done.
-
Chances can only be done during the sketching phase.
-
I will only do 2 alterations after that fees will be applied.(Sketch phase)
-
IF, in the event I missed a crucial feature in your reference in the final design I will change it for free. HOWEVER, I do follow the reference provided so any changes not in the reference will not be done.

No alterations will be done after the piece is finished, only at the sketch phase.
Canceling/Refund Policy
-
If anything happens that I, the artist, can’t complete your commission, you’ll get a full refund.
-
Once I started the inking process, no refunds will be accepted.
-
I have the right to cancel and refund the money for your commission at any time.***
-
If rude behavior is presented towards me, the artist, I have the right to cancel your commission and refund you half of the commission for wasting my time.
-
If you decide to cancel the commission, you’ll receive a partial refund at the sketching phase. Once at the inking phase no refunds will be accepted.

I will not give refunds for failure to manage personal situations.
If a commission was canceled, I reserve the right to re-use works in ways including:

Creating an YCH image using the drawn poses
-
Changing elements in a finished image to remove association with the commissioned character
-
Personal work.

Portfolio and display
I further reserve the right to repurpose rejected sketches for any purpose I may have.

*Any chargeback is in direct violation of the terms of service. Therefore any right towards the art will be revoke.
*The commissioner will be blacklisted, and no further business will be done.
*I have the right to warn other artists at my discretion.
Code of Conduct
-
Rudeness, harassing or threatening behavior, or other unacceptable conduct will not be tolerated and will result your commission being cancelled.

Harassments towards commission updates and wanting the art done quick will result on the commission being cancelled.
Copyright / Usage Policy
I, the artist, hold every right to the produced drawing, not the commissioner.
Therefore I´m allowed to use the copyrighted artwork to:
Promote myself with in any place or site.
Publish books with.
To display it anywhere to my liking.
Post it wherever I want.
Use it for portfolio purposes.
The commissioner are allowed to:
Use the copyrighted artwork for personal use only.
Print the art, and claim the right of their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to the artist.
Use the image in their social media with proper credit is given.
Request that their name be anonymised if the work is uploaded on the artist's social medias.
*If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:
Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)
Taking credit for the creation of the artwork.
Removing any watermarks/signatures.
Altering, editing, or selling the artwork in any way without my, the artist´s, consent.
Employing the services of another artist to make edits to my work.
